Pro-actions Business Coaching and Support Ltd (“Pro-actions”) is incorporated in England and provides management consultancy services. We are committed to protecting any data that we collect concerning you. By using our services, you agree to the use of the data that we collect in accordance with this Privacy Policy.

This Policy indicates the type of processes that we operate and how they may result in data being collected about you. Your use of this website gives us the right to collect and use that information.

Website cookies and link tracking

Cookies allow us to provide important site functionality so you don’t have to re-enter lots of information. They also allow us to remember which links and pages have been clicked or viewed during a session. IP address lookup

We use third parties to provide information about visitors to our websites (for example Google Analytics). When you visit our websites, we will record your IP address. This address will be matched against public and proprietary IP address databases to provide us with information about your visit. This information may identify the organisation to whom the IP address is registered but not individuals. In some limited cases i.e. single person companies, it may be possible to identify personal data from publicly available ICANN data.

Personal Data that we collect

We may collect personal data such as, but not limited to:

  • Name
  • Email address
  • Phone number
  • Business Address
  • Business name;
  • Job title;

We do not collect sensitive data (for example data pertaining to payment or bank details, or ethnicity etc) or data pertaining to minors.  If you constitute a minor, please do not submit personal details to us through our contact or signup forms.

How we collect your contact data

We collect your contact data through some or all of the following means:

  • Sign up forms on our website where you have requested to receive information from us
  • Booking forms for our events when you sign up to attend an event using the Eventbrite platform
  • Use of our online tools (such as the Business Health Assessment) where you complete contact details as part of the registration to use them.
  • Interaction with our staff and coaches (such as when you provide your contact details to them to remain in contact).

How long we hold your data for

We will only retain your personal data for as long as is necessary to fulfil the purposes for which it is collected. When assessing the retention period we take into consideration:

  • the requirements of our business and the services provided;
  • any statutory or legal obligations;
  • the purposes for which we originally collected the personal data;
  • the lawful grounds on which we based our processing;
  • the types of personal data we have collected;
  • the amount and categories of your personal data; and
  • whether the purpose of the processing could reasonably be fulfilled by other means.

Legitimate interest and purposes for which we may use your contact data

As from 25 May 2018, under the General Data Protection Regulation and The Privacy and Electronic Communications (EC Directive) Regulations 2003, Pro-actions will rely on legitimate interest as per GDPR Article 6(1)(f) for the legal basis to some of its processing of personal data for electronic communication.

This legitimate business interest permits Pro-actions to conduct direct marketing to its business customers and prospects by email. Individuals are free to opt out of email contact at any time and links enabling this are always included at the bottom of such emails.

The purposes for which we will use your contact details may include:

  • Sending information about Pro-actions, our website and our products
  • Sending promotional offers, including the promotion of our free to attend business educational events
  • Sending information-based communications designed to provide business education and professional development to SME business managers

Without these contact opportunities, Pro-actions would lose a key activity in building awareness in its website and products that would seriously damage the company’s ability to generate revenue.

Our schedule of activity will limit our contact to ensure our communication does not become intrusive.

Articles 47 and 48 of the GDPR in conjunction with The Privacy and Electronic Communications (EC Directive) Regulations 2003 states that direct marketing activity is a legitimate interest and allows email contact, without prior consent, when conducting business to business campaigns.

By submitting your contact details to us you are consenting to receive the particular piece of information you requested as well as allowing us to send you appropriate and useful communications as outlined above.

Email marketing campaigns – Mailchimp

Email marketing campaigns are published by this website or its owners through the Mailchimp platform and may contain tracking facilities within the actual email. Subscriber activity is tracked and stored in the Mailchimp database for future analysis and evaluation. Such tracked activity may include; the opening of emails, forwarding of emails, the clicking of links within the email content, times, dates and frequency of activity.  This information is used to refine future email campaigns and supply the user with more relevant content based around their activity.

Social Media Platforms

This website and its associated communications may use social sharing buttons which help share web content directly from web pages or emails to the social media platform in question. Users are advised before using such social sharing buttons that they do so at their own discretion and note that the social media platform may track and save your request to share a web page respectively through your social media platform account.

Users are advised to use social media platforms wisely and communicate / engage upon them with due care and caution in regard to their own privacy and personal details. This website nor its owners will ever ask for personal or sensitive information through social media platforms and encourage users wishing to discuss sensitive details to contact them through primary communication channels such as by telephone or email.

Subject Access Requests and updating your preferences and contact details

Under the Data Protection Act 1998 you may request a copy of personal information held about you. At our discretion, we may charge a small fee for the provision of this. If you would like a copy of the information held on you please email us at enquiries@pro-actions.com.   We will use reasonable efforts to supply, correct or delete personal information about you on our files.

You can update your communication preferences by clicking the link in any emails you receive from us. The link will always be in the footer of the email. Disclosure of the information we collect and hold about you

The personal information you give us when submitting your contact details or that we collect when you use our site is confidential and except in the circumstances mentioned below, we will not disclose it to any third party outside of the companies that operate this website and/or the email marketing campaigns on our behalf.

We may, however, disclose the information to a third party in the following circumstances:

  • If required or permitted to do so by law;
  • If required to do so by any court, or any applicable regulatory, compliance, governmental or law enforcement agency;
  • If necessary in connection with legal proceedings or potential legal proceedings;
  • If ownership of all or part of our Site is transferred, in which case any purchaser would only be entitled to use that information in a way consistent with this Privacy Policy;
  • If you provide your details as part of using a co-branded tool or attending a co-branded event. Examples of these situations might include (but not necessarily be limited to) submitting a Business Health Assessment offered in conjunction with an accountancy firm, or registering for a Pro-actions event that is jointly hosted by Pro-actions and, for example, a bank or local authority. In these co-branded circumstances, we may share your contact details with the co-branding partner and your data once shared with them will be subject to their own privacy and data policies.
